General Terms & Conditions

By placing an order with Bullion Club Australia (Bullion Club) you are taken to have accepted to the Terms & Conditions as set out hereafter. Bullion Club reserves the right to make changes to these conditions at any time, and encourages you to review them periodically.

Metal Purchase. Precious Metal is purchased on the buyer’s behalf and the metal price fixed at the time a customer order is placed either via telephone, over-the-counter, or on the website www.bullionclub.com.au.

Binding Contract. A binding contract to purchase exists once the buyer agrees the price and places the buy order - either verbally by telephone or in person, or online. At this time, the buyer assumes all price exposure risk on the goods. A copy of the order confirmation will be emailed or faxed to the buyer. When placing telephone orders, buyers are required to reply the order confirmation email or sign and return this document by fax within one hour to verify receipt. The contract to purchase is legally binding notwithstanding the non return of this document.

Currency. We are currently trading in Australian Dollar Only and all prices in this document are in Australian Dollar.

Payment. Full payment is due within 1 business days of placing an order in which the metal priced has been fixed. Non-payment will result in cancellation of the contract and recovery of costs from the buyer – see ‘Contract Completion Guarantee’ clause below. For orders of $10,000 or more, a 30% deposit in cleared funds must be received prior to placing an order which fixes the metal price. For orders of $100,000 or more 70% in cleared funds must be received prior to placing an order which fixes the metal price. Funds in payment must originate from the verified customer’s account.

Customer Identification. Under Australian law, Bullion Club is required to identify customers of bullion products. All customers must register a Bullion Club Account before placing any orders. In the case of orders for bullion products placed either via telephone, in person, or via our website www.bullionclub.com.au for $10,000 or more, the customer is required to provide appropriate certified identification documents. Initially, scanned copies of these documents delivered by email or fax or attached to the online registration application is acceptable to establish a preliminary online account and place an order (order restrictions may apply). But then these certified/notarized document copies including the certifier’s original signature, must be delivered to Bullion Club by mail to fully satisfy this requirement prior to the establishment of a full trading account and the despatch of any goods.  Non-delivery of these ID documents by mail will result in cancellation of your trading account and recovery of any applicable fees and/or metal price losses under the ‘Contract Completion Guarantee’. Appropriate ID requirement for individuals is two certified/notarized photo ID documents (passport and driver licence) which give the customer’s full name, date of birth and residential address. ID requirements for all other entities, such as companies, trusts etc. are as specified in the Customer Identification Documents section. Bullion Club reserves the right to request additional customer identification information, at its discretion. Certified ID documents including the certifier’s original signature must be posted to Bullion & Coin Club Australia, Suite 6, Level 1, 428 George Street, Sydney NSW 2000, Australia.

Pricing. All prices quoted on www.bullionclub.com.au are updated only during bullion trading hours Monday to Friday (excluding Public Holidays). These prices are indications of Bullion Club’s retail and bulk prices and are not firm commitments to buy or sell at the indicated price. Prices will be confirmed at the time of purchase/sale. Bullion Club cannot accept any liability for any loss suffered as a result of any action of any kind taken by any person based on this pricing information and reserves the right to decline any trade involving pricing or inventory errors caused by computer errors or malfunctions. Combined per unit prices quoted are made up of the metal content at the prevailing Perth Mint spot price plus manufacturing and sales premium. As metal is purchased on your behalf on placement of your order, fixing of the metal price in advance of payment is offered as a service to buyers on condition that all Terms & Conditions are met. Bullion Club reserves the right to require full or part payment prior to fixing the price, as it sees fit.

Goods and Services Tax (GST). GST is not charged on Bullion whether sold in Australia or overseas. For sales in Australia, GST is charged on freight and insurance. For sales overseas, where the product is exported, GST is not charged on freight and insurance, except if the products are not exported within 60 days of order.

Deliveries for payments made via PayPal.  All online transactions made via PayPal cannot select the “pick up from store” option for shipping. Furthermore, all orders cannot change their previously designated shipping address once the order has been confirmed. Should orders not be provided with a designated address or preferable shipping option, Bullion Club reserves the right to cancel the order. In no situation will customers be allowed to pick up purchased items via PayPal in person.

Deliveries in Australia. The default shipping method for orders contains silver bullion only will be Australia eParcel Standard (Registered Post). The default shipping method for orders contains any gold or platinum will be Australia Post eParcel Express (Express Post). Both shipping methods are online trackable and the tracking number will be provided upon request.

Deliveries for overseas. All overseas orders will be sent via online trackable International couriers and the tracking number will be provided upon request.

Insurance. The insurance is offered for orders of $500 or more and the premium of the insurance is included in the quoted Shipping & Insurance for Australian buyers, up to a value a maximum of $20,000 per shipment per day. In the case of insurance claim, excess fee of $500 will be at the full cost to the buyer. Orders under $500 are not insured and the insurance premium is not included in the Shipping & Insurance charge. The insurance can be waived by the buyer in writing and the Shipping & Insurance charge can be adjusted upon request. By choosing not to pay for insurance, the customer will be liable for any loss under any circumstances. Any claim for lost or damaged goods must be made within 48 hours of despatch.

Despatch. Bullion Club will endeavour to despatch bullion orders within 10 business days after receipt of full payment in cleared funds. In the event of high demand or short in supply, delivery delays could occur. Bullion Club accepts no liability for any losses incurred in the event of delayed deliveries. 

Returns. No returns of Bullion are accepted. 

Deposits. For orders of $10,000 or more, a 30% deposit in cleared funds must be received prior to placing an order which fixes the metal price. For orders of $100,000 or more 70% in cleared funds must be received prior to placing an order which fixes the metal price. Funds in payment must originate from the verified customer’s account. A deposit may also be requested in other circumstances regardless of the order value, at Bullion Club’s discretion. 

Contract Completion Guarantee. All orders for bullion products made via telephone or online for $5,000 or more may be required to provide a ‘Contract Completion Guarantee’ with the provision of the buyer’s credit card. In the event of non-completion of the terms of the Sales Contact by the buyer resulting in the cancellation of the contract, an administration fee of $150 plus any losses incurred by Bullion Club in the liquidation of metal held on behalf of the client, will be charged to the credit card. Any gains resulting from liquidation of metal will not be remitted to the client. The credit card must be current and in the name of the buyer. The credit card provided for this Guarantee is not authorised for any other charge or payment.

Buy-back. The buy-back from a customer of bullion product which has yet to be paid for or delivered will not be undertaken. Buy-back of undelivered bullion may be undertaken only if the original purchase has been paid in full with cleared funds (delay of 7 working days applies).

Accepted Payment Methods.

The following payment methods are accepted for Australian buyers:

  • BPay - No Surcharge, Clearance Period 2 business days
  • EFTPOS in store - No Surcharge, Clearance Period 1 business day
  • Credit Card in Store – 2% surcharge for VISA and MASTERCARDS, 3.5% surcharge for American Express
  • Paypal (3% surcharge) – Clearance Period 2-10 business days

For BPay. The specified BPay Reference Number must be quoted as a reference when paying by BPay so we can identify your payment and ensure that your funds are allocated correctly. The buyer is required to send the payment receipt by email to accounts@bullionclub.com.au or by fax to 02 9233 6576. Bullion Club is not liable for any delays in receipt of clients’ funds into its bank account or lack of notification thereof.

For Pay in Store. It is the customer’s responsibility to check the daily limit or credit balance before processing the EFTPOS or Credit Card transaction. Full identification check is required for all credit card payment.

For Paypal. Paypal payment is instant for online purchase but Bullion Club will not despatch the order until the Paypal payment is settled in our bank account. Please note that for all Paypal transcations, the buyer is only allowed to have the items shipped to their nominated shipping address and is will not be allowed to pick up from store.

Trading Hours. Trading hours applicable online www.bullionclub.com.au are normal Bullion Club trading hours of 10:30am to 5:00pm Monday to Friday, excluding public holidays. Orders for bullion will be accepted by telephone between the same hours (telephone orders require order confirmation by 5:00pm). After hours trading is also available via our website, at a higher premium to cover cost fluctuation. Please be aware that the price we charge after hours may be higher than the normal trading hours and the supply is not guaranteed. In the case that we have to decline any after hours orders, we will notify the customer within 1 business day.

Security. Bullion Club employs various security procedures including but not limited to: identity verification, address checking, computer IP address verification and credit card screening. All telephone orders maybe recorded and all in store purchase may be filmed.

Advice. Bullion Club Australia does not provide investment or taxation advice. Customers consult their own advisors for guidance and recommendations on these issues. 

Jurisdiction. These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of New South Wales Australia.

 

Customer Identification Documents

Customer Identification Documents For Individuals

Individuals are required to provide identification which details their full name, date of birth and current residential address.

Two identification documents are required, which must consist of at least one Primary Photographic ID document stating the date of birth and at least one document stating current residential address. Copies of identification documents are to be certified/notarized as specified below.

The preferred Primary Photographic ID documents are:

  • Passport: Australian or foreign, containing photograph and signature; and
  • Drivers Licence: Australian or foreign, containing photograph and signature.
  • The preferred Primary Non-photographic ID documents are;
  • Birth Certificate: Australian or foreign; or
  • Utility Bill, less than three months old and issued by a government body or utilities provider for provision of services (rates, electricity, gas, water) containing the name of the individual and current residential address.

If one of the above documents are not available, then please provide a:

  • National identity card: foreign, containing a photograph and signature,
  • Proof of Age card: issued by Australian State or Territory, containing photograph.
  • Citizenship Certificate: Australian or foreign.
  • Pension or Social Security Card: issued by a Government authority.

Customer Identification Documents For Companies

Companies are required to provide corporate identification documents which include the business registration details, names of directors, and for private companies, the details of shareholders.

For Australian registered companies please provide:

  • ASIC Company Statement; and
  • ASIC Certificate of Incorporation; and
  • The individual identification documents as detailed above for the Director/Office Holder nominated to operate the account.

For foreign registered companies please provide:

  • Certificate of company registration issued by the relevant foreign registration body: and
  • A company statement including a listing of directors, and for private companies; a listing of shareholders; and
  • The individual identification documents as detailed above for the Director/Office Holder nominated to operate the account.

Customer Identification Documents For Trusts and Trustees

Trusts are required to provide identification documents for both the Trust and the Trustee nominated to operate the account.

The following documents are required:

  • Trust Deed (first page and last few pages with the name and signature of the Trustee(s); and
  • If the Trustee is an individual, then please provide the individual identification documents as detailed above.

If the Trustee is a company, then please provide corporate identification documents as above; plus the individual identification documents as detailed above for the Director/Office Holder nominated to operate the account.

 

NOTES for all above-mentioned Identification Verifications:

  • All identification documents must be current, except for passports, which may be less than two years expired.
  • If any of the above foreign documents are written in a language other than English, they must be accompanied by an English translation prepared by an accredited translator.
  • A certified copy means a document that has been certified as a true copy of an original document by one of the following persons.
  • The following individuals are eligible to certify copies of ID documents in Australia:
    • Legal practitioner (including lawyers, judges, magistrates, registrar of a court)
    • Medical practitioner
    • Pharmacist
    • Justice of the Peace
    • Commissioner of Declarations
    • Commissioner of Affidavits
    • Notary Public
    • Police officer
    • Member of a professional accounting body
    • Australian Consular Official
    • An authorised representative of a financial institution
  •  The certifying officer must:
    Stamp or write on the copy: “This is a true copy of the original documents sighted by me.” AND
    • Sign and print their name, and affix an official stamp where applicable. AND
    • State their profession or occupation group. AND
    • Write on the copy the date certified.

 

Privacy & Security

Bullion Club Australia (Bullion Club) does not disclose personal information about any of its customers to any unrelated third party businesses. We do not sell, rent, lease, loan, trade or otherwise divulge the addresses on our lists to unrelated third parties or any unauthorised personnel.

Information may be disclosed to authorised government and legal authorities, and authorised contractors conducting business on behalf of Bullion Club and its customers.

Bullion Club takes privacy very seriously, and only uses ecommerce and internet products endorsed or recommended by the major banking and technology sector organisations. Furthermore, it follows industry recommended best practice procedures and continually upgrades and improves the methods used on this website.

Collecting Information. Personal information, such as your name and e-mail address, is collected only to record and process your order, and, if you chose to join as a Bullion Club member, to keep you informed of new product releases and events at Bullion Club. Information about IP addresses, web browsers, and computer operating systems are automatically transmitted to web servers as an integral part of the operation of the internet. This information is used for demographic purposes as a technical resource to better serve web site users. Data is analysed for trends and statistics, and then discarded. Our Web site logs are not personally identifiable and we make no attempt to link them with the individuals that actually browsed the site. For security purposes, network management and to improve our service we use software and third party services to monitor network traffic, detect unauthorised and malicious access of the site, and determine the effectiveness of our site structure.

Online Transactions. If you place orders on this site, information including your credit card number and contact information is of necessity collected. This information is used solely to record and fulfil your order. Credit card details are not stored on this website. Transactions are processed through the national merchant gateway authorised by the four major Australian banks. 

Online Security. Personal information provided to Bullion Club Online Shop is encoded using Secure Sockets Layer (SSL) technology, a powerful encryption protocol that protects data as it travels over the Internet. Credit card transactions are processed using the secure EFTPOS network. For enhanced security, we recommend using the latest Netscape Navigator or Microsoft Internet Explorer browsers, which enable SSL. Make sure to set your browser's preferences to accept cookies and enable JavaScript.

Cookies. Our online store uses 'cookies' to store information on the items you place in your shopping cart, and facilitate the online shopping process. Cookies are also used to provide a more efficient and dynamic service to regular customers.

Email Lists. Visitors can request to join a mailing list by joining the Bullion Club membership. We maintain this list of Bullion Club members to inform them of new information on this Web site. We do not sell, rent, lease, loan, trade or otherwise divulge the addresses on our lists to third parties or any unauthorised personnel.

Spam Act 2003. Bullion Club complies with the Spam Act 2003 and best practice guidelines in relation to the contents of its commercial electronic messages. Bullion Club only sends e-mail advertising with each addressee's consent, includes its address and contact details in every e-mail promotion, and ensures the inclusion of a functional unsubscribe facility.
